Effective October 26, 2026

Email Acceptable Use Policy.

The short version

  • Upload only lists you have the right to email: businesses in the United States, no consumers, no addresses that opted out or are on a do-not-contact list, nothing scraped or harvested.
  • Be who you say you are. Your legal business name and postal address go on every outreach email, and subject lines must match what the email says.
  • Make only claims you can support: no guaranteed approvals, no invented rates, no pressure tactics, and the disclosures your state requires when you quote terms.
  • DealStake stops on its own when a recipient replies STOP, unsubscribes, asks not to be contacted or hard-bounces. Those stops cannot be overridden, and we hold contacts we identify as located in Canada.
  • DealStake sets the volume and timing of sending and may pause sending that risks the service. You may not work around those limits.
  • Outreach email carries no links. Replies may carry the links you configure, such as your application page.

This summary is a reading aid and is not part of the Agreement. If it differs from the full text, the full text governs.

1. Scope

1.1 Part of the Agreement. This Email Acceptable Use Policy (this "AUP") is part of the Terms of Service (the "Terms") and applies to every communication sent from a Workspace, including outreach, follow-ups and replies. Capitalized terms have the meaning given in the Terms.

1.2 Purpose. The duties in this AUP protect every customer's ability to reach the businesses it emails.

2. Lists

2.1 Representations. Each time the Customer uploads a list and each time the Customer launches a Campaign, the Customer represents, warrants and covenants that, for every contact on the list:

  • (a) the Customer has the right under Applicable Law to contact the business by commercial email, and any purchased or licensed list permits that use through a service provider;
  • (b) the list contains no address that has opted out of email from the Customer, has asked not to be contacted, or appears on a do-not-contact list that applies to the Customer, and the Customer has applied its own suppression records before uploading;
  • (c) the contact is a business, or an individual acting on behalf of a business; the Services are not for consumer marketing;
  • (d) the contact is located in the United States, unless the Customer holds the consent that the recipient's jurisdiction requires; Canada, the European Union, the United Kingdom and other jurisdictions require consent or a prior relationship for commercial email, and the Customer is responsible for excluding contacts in those jurisdictions; and
  • (e) the Customer did not obtain the list by scraping websites, harvesting addresses, or in breach of a license, terms of use or obligation of confidence.

2.2 Markings Honored. Where a list marks a contact as opted out or not to be contacted, DealStake honors that marking at import.

3. Identity

3.1 Sender Identification. Each outreach communication carries the Customer's legal business name and a valid postal address, which the Customer supplies in its business profile and must keep current.

3.2 No Misrepresentation. Subject lines must reflect the content of the communication. The Customer must not configure a sender name, signature or business description that misrepresents who the Customer is, what it offers, or its relationship to the recipient.

4. Content and Claims

4.1 Responsibility. Communications are generated from the Customer's settings and examples. The Customer is responsible for what those settings cause to be sent.

4.2 Prohibited Claims. A communication sent from a Workspace must not:

  • (a) state or imply guaranteed approval, guaranteed funding, instant funding, or a specific rate, amount or timeline that the Customer cannot support;
  • (b) state or imply that no personal guarantee, no collateral or no credit check applies, unless that is true for the product offered;
  • (c) misrepresent or conceal fees, costs, factor rates or repayment terms;
  • (d) pressure a recipient through false urgency or threats;
  • (e) impersonate a lender, a government body or another company; or
  • (f) promote anything unlawful, or anything unrelated to a legitimate business offer.

4.3 Financing Disclosures. If the Customer quotes financing terms to a Merchant, the Customer must give every disclosure that the recipient's jurisdiction requires, at the time required, including under the New York Commercial Finance Disclosure Law and California's commercial financing disclosure rules. DealStake does not make, arrange or decide on financing.

5. Automatic Stops

5.1 Stops DealStake Applies. DealStake applies the following stops without instruction, and the Customer may not ask DealStake to override them:

  • (a) a reply that asks to stop, to unsubscribe, to be removed or not to be contacted stops all communications to that Merchant from the Workspace, including scheduled follow-ups and queued replies;
  • (b) a Merchant marked do-not-contact, or whose address hard-bounces, is not emailed again;
  • (c) a Merchant that DealStake identifies as located in Canada is held and is not emailed; and
  • (d) a Merchant that the Customer removes and later imports again inherits any stop that DealStake can still associate with the contact.

5.2 Scope of a Stop. A stop applies to the Workspace that received it. DealStake does not apply one customer's opt-out records to another customer's lists. Where Email Laws give a recipient the right to be removed from all communications from a sender, the Customer remains responsible for the lists it holds outside the Services.

6. Volume and Timing

6.1 Limits. DealStake determines the volume and timing of sending from each sending account and across the Workspace, within the days the Customer's settings allow. The Customer must not attempt to exceed or circumvent those limits, and must not send the same communication to the same list from outside the Services at the same time.

6.2 Pausing. DealStake may limit or pause sending that risks the Services or breaches this AUP, and will tell the owner of the Workspace what it observed and what resolves it, unless Applicable Law or the risk to other customers does not permit notice. Repeated or severe harm, or a refusal to resolve the cause, is grounds for suspension under the Terms.

7.1 Outreach. Outreach communications and follow-ups sent by the Services carry no links.

7.2 Replies. Replies may carry the links the Customer configures in its settings, such as an application page or a secure upload page.

7.3 Prohibited Content. A communication sent from a Workspace must not carry attachments, tracking pixels added by the Customer, or links to sites that are deceptive or unlawful.

8. Prohibited Uses

The Customer must not use the Services to:

  • (a) send communications to anyone under eighteen, or to consumers for personal, family or household purposes;
  • (b) send phishing, malware, or communications designed to collect credentials or payment details;
  • (c) send on behalf of a business other than the one named in the Workspace without a written agreement with DealStake;
  • (d) test the security of the Services, access another customer's Workspace, or interfere with the Services; or
  • (e) resell, sublicense or make the Services available to third parties.

9. Enforcement

9.1 Remedies. A breach of this AUP permits DealStake to limit or pause sending, suspend the Workspace or close it under the Terms, and the Customer is responsible under the Terms for claims and costs that follow from its lists and content.

9.2 Notice. DealStake will tell the Customer what it observed and give the Customer an opportunity to resolve it, except where Applicable Law, the risk to other customers or the integrity of the Services requires immediate action.

10. Changes

DealStake may update this AUP when Applicable Law, the practices of mail providers or the Services change. Changes follow Section 16 of the Terms.
